[PLATFORM TERMS]

Terms & Conditions

The rules that govern learner accounts, online course access, assessments, payments, certificates, and use of the ProSafe Globally e-learning platform.

Effective date: 15 June 2026

1. Acceptance of these terms

These Terms & Conditions govern your access to and use of the ProSafe Globally website, learner portal, online courses, assessments, downloadable materials, certificates, support services, and related digital learning services (the “Platform”).

By creating an account, enrolling in a course, making a payment, or using the Platform, you confirm that you have read and accepted these terms. If an organization enrolls you, both you and the organization are responsible for complying with the terms that apply to your use.

2. Eligibility and learner accounts

You must provide accurate, current information and keep your login credentials confidential. You are responsible for activity performed through your account and must notify us promptly if you suspect unauthorized access.

Accounts and course access are personal to the registered learner unless ProSafe Globally has approved a corporate or group arrangement. You may not share credentials, impersonate another learner, create accounts using false information, or allow another person to complete training or assessments on your behalf.

3. Enrollment, access, and course requirements

Course descriptions identify the intended audience, learning format, prerequisites, expected duration, assessment requirements, and certification conditions where applicable. You are responsible for confirming that a course is suitable for your needs before enrollment.

Access periods may vary by course, cohort, corporate agreement, or promotion. Completion requires satisfying the published learning activities and any attendance, identity verification, practical, or assessment requirements. Merely purchasing or opening a course does not guarantee completion or certification.

4. Fees, payments, cancellations, and refunds

Prices, taxes, payment schedules, and accepted payment methods are shown during enrollment or stated in a proposal or invoice. Course access may be withheld or suspended while payment is outstanding.

Cancellation, transfer, and refund eligibility depends on the specific course, delivery format, access already provided, cohort commitments, and any written corporate agreement. Unless a separate written policy or agreement states otherwise, refund requests must be submitted before substantial digital course content has been accessed and before a scheduled live session begins. Approved refunds may exclude non-recoverable transaction or administrative costs.

ProSafe Globally may reschedule or cancel a course where necessary. In that event, we may offer a transfer, account credit, replacement delivery date, or refund for the affected service, as appropriate.

5. Assessments and academic integrity

Assessments must be completed independently unless collaboration is expressly permitted. Cheating, copying, unauthorized assistance, answer sharing, assessment manipulation, or misrepresentation of identity is prohibited.

We may review attempt records, timestamps, submitted work, identity evidence, and other relevant platform activity when investigating suspected misconduct. Confirmed misconduct may result in a failed assessment, certificate withdrawal, access suspension, or account termination without refund.

6. Certificates and professional recognition

A certificate is issued only when the stated completion, attendance, practical, identity, payment, and assessment conditions have been met. Certificates reflect the course and achievement described on the certificate and do not by themselves grant a professional license, statutory authorization, or permission to perform regulated work.

Employers, regulators, and other third parties remain responsible for deciding whether a certificate satisfies their requirements. We may correct, replace, suspend, or revoke a certificate that was issued in error, obtained through misconduct, or based on inaccurate learner information.

7. Safety and educational limitations

The Platform provides education and professional development. Online content does not replace site-specific risk assessments, practical supervision, competent-person decisions, manufacturer instructions, emergency procedures, medical advice, or compliance with applicable laws and standards.

Learners and organizations remain responsible for applying appropriate controls and obtaining any additional practical training, authorization, equipment, or professional advice required for their activities. Course materials may describe general good practice but cannot account for every workplace, hazard, or legal jurisdiction.

8. Intellectual property and permitted use

The Platform and its courses, videos, presentations, graphics, assessments, documents, trademarks, and other materials are owned by or licensed to ProSafe Globally and are protected by applicable intellectual property laws.

We grant enrolled learners a limited, non-exclusive, non-transferable right to access assigned materials for personal learning or approved internal organizational training. You may not reproduce, record, publish, sell, sublicense, distribute, scrape, modify, upload elsewhere, or use the materials to create competing training without prior written permission.

9. Acceptable use

You must not interfere with Platform security or availability; introduce malicious code; attempt unauthorized access; probe or bypass access controls; automate extraction of content; harass other users or staff; submit unlawful or harmful material; or use the Platform in a way that infringes another person’s rights.

You must use discussion, messaging, upload, and support features professionally. We may remove content or restrict functionality where reasonably necessary to protect learners, staff, systems, or legal compliance.

10. Platform availability and changes

We aim to provide reliable access but do not guarantee uninterrupted or error-free operation. Maintenance, updates, connectivity failures, third-party services, security events, or circumstances outside our control may temporarily affect access.

We may update course content, instructors, schedules, assessments, technical requirements, or Platform functionality to maintain quality, accuracy, security, or compliance. Where a material change affects an active paid enrollment, we will take reasonable steps to provide an appropriate alternative.

11. Privacy and learner records

We process account details, enrollment information, payment records, learning activity, assessment results, certificate data, support communications, and technical information to operate the Platform, provide training, maintain records, prevent misuse, and meet legal or contractual obligations.

Where an employer or sponsoring organization pays for or manages training, relevant progress, attendance, assessment, and certification information may be shared with that organization as part of administering the enrollment. Learners should contact us with questions about access to or correction of their personal information.

12. Suspension and termination

We may suspend or terminate access where there is non-payment, misuse, academic misconduct, a security risk, a breach of these terms, or a legal requirement to do so. Where reasonable, we will provide notice and an opportunity to address the issue.

Termination does not remove payment obligations already incurred or provisions that by their nature continue after access ends, including intellectual property, records, disclaimers, and liability provisions.

13. Disclaimers and limitation of liability

To the extent permitted by law, the Platform and course materials are provided on an “as available” basis. ProSafe Globally is not responsible for losses caused by a learner’s failure to follow applicable law, workplace controls, professional advice, or course requirements.

ProSafe Globally will not be liable for indirect, incidental, special, or consequential loss arising from use of the Platform. Our total liability relating to a paid course will not exceed the amount paid to us for that specific course, except where liability cannot lawfully be limited or excluded.

14. Governing law and changes to these terms

These terms are governed by the laws of the Republic of Rwanda. The parties should first attempt to resolve any dispute in good faith by contacting ProSafe Globally before pursuing formal remedies in the competent courts of Rwanda.

We may update these terms to reflect changes to the Platform, our services, or legal requirements. The revised version will be posted on this page with a new effective date. Material changes may also be communicated through the Platform or by email.

15. Contact

Questions, notices, account concerns, and refund requests relating to these terms should be sent to ProSafe Globally in Kigali, Rwanda.
